What Is Equitable Distribution?
The division of a couple's property is often a highly contentious aspect of the divorce. The most important thing to know about property division if you are considering divorce is that Pennsylvania is an equitable distribution state. This means that marital property will be divided in the way that the courts rule to be fair — which does not always mean equally.
The law makes a distinction between marital property — those assets acquired during marriage — and nonmarital property. Nonmarital property includes assets that either partner acquired before the marriage, gifts or inheritances given to only one of the spouses, and other items excluded by a prenuptial agreement. Only marital assets will be divided. Courts have a significant amount of discretion, and will consider numerous factors — but an experienced attorney will tell you what you can reasonably expect.
