Starting A Pennsylvania Workers’ Compensation Claim

If you have been injured at work, or diagnosed with a work-related illness, and do not know how to go about starting a claim, you are not alone. Many injured workers, and even many employers, do not understand the claims process.

At Wolf, Baldwin & Associates, P.C., we can help you understand what your rights are, what the law says, and how the workers’ compensation claims process works in the Commonwealth of Pennsylvania. More importantly, we can help you obtain all the benefits you deserve for your work-related injury, or illness.

A Step-By-Step Approach

The first step in starting a Pennsylvania workers’ compensation claim is to report the injury, or illness to your employer, or a supervisor (not just to a co-worker). Do this as soon as possible. If you don’t, you will open the door for your employer, and its workers’ compensation insurance provider to claim that you were not actually injured at work.

Second, call an experienced workers’ compensation lawyer for a free consultation. Do this even if your employer has accepted your claim, or agreed to compensate you without going through the workers’ compensation system. Your employer, or insurance carrier will often “leave out” critical information, either on purpose, or by accident.

Third, get appropriate medical care from a qualified physician, and make sure that you follow through on any treatment the doctor recommends. If you notify your employer, and it accepts your claim, you may have to choose the doctor from a list your employer provides. If your employer does not have a list, you may be able to choose your own doctor. Call one of our attorneys to discuss the specific requirements of the workers’ compensation law regarding panel physicians, and the so-called “90-day rule.”
